SC orders release & tepatriation of Pakistani citizen Hai

KATHMANDU: The Supreme Court has issued an order in the name of the Immigration Department and other agencies to release Mojam Abdul Hai, a Pakistani citizen who is in custody.

A joint bench of Justice Sushmalta Mathema and Dr. Manoj Kumar Sharma on Friday ordered the release of Pakistani citizen Hai and his return to his country.

Hai, a Pakistani citizen, was arrested and detained by the government on October 7, 2019, claiming that he was staying in Nepal without regularizing his visa.

Noting that he had stayed in Nepal for 823 days without regularizing his visa, the Immigration Department had decided to impose a fine of Rs.781,389.12 on the visa and delay fee of Rs. 50,000.

The department imprisoned Pakistani citizen Hai for seven years after failing to pay the sum.

Hai petitioned the Supreme Court, requesting that he be released from prison and sent to his home country.

The court ordered the government to release Hai and return him to his home country, citing violations of judicial standards and norms.

The case was argued by lawyers Bikash Bhattarai and Manish Kumar Shrestha.
