Shekhar Golchha remains in custody despite SC bail order

KATHMANDU: Supreme Court has ordered the release of prominent businessman Shekhar Golchha on bail in a securities-related case, but he remains in custody due to a separate ongoing investigation involving alleged insurance-related offenses, police officials said.

A joint bench of Justices Mahesh Sharma Paudel and Shrikanta Paudel issued the order on Monday, directing authorities to release Golchha on bail or surety in connection with a securities case.

The ruling came in response to a habeas corpus petition filed by his wife, Seema Golchha.

However, Golchha has not been freed, as the court’s decision applies only to one of two cases under investigation.

According to Senior Superintendent of Police Shiva Shrestha, spokesperson for the Central Investigation Bureau (CIB), Golchha continues to be held over a separate insurance-related case. “He remains in custody in connection with the insurance investigation, which is still active,” Shrestha said.

Golchha was arrested on April 24 (Baisakh 11) by Nepal Police’s Central Investigation Bureau following further investigation based on a report by the Securities Board of Nepal.

Authorities say the case involves alleged irregularities in the securities sector, while details of the insurance-related investigation have not been fully disclosed.

Legal experts note that bail orders in one case do not automatically apply to other pending charges, allowing law enforcement agencies to continue detention if separate investigations justify custody.
