Writ to SC to vacate the post of Speaker & Deputy Speaker

The Prime Minister and Council of Ministers Office, the Ministry of Law, and the Federal Parliament Secretariat have all filed writs against the Speaker and Deputy Speaker.

KATHMANDU: The Supreme Court has been petitioned to vacate the positions of Speaker Agni Prasad Sapkota and Deputy Speaker Pushpa Bhusal. On Thursday, attorneys Kishore Poudel, Jagannath Dulal, and Anupam Bhattarai filed the writ.

The Prime Minister and Council of Ministers Office, the Ministry of Law, and the Federal Parliament Secretariat have all filed writs against the Speaker and Deputy Speaker.

As the Election Commission has already published the closed list for the House of Representatives proportional representation, the writ also requests that the Speaker and Deputy Speaker refrain from using the services and facilities provided until the case is resolved. The writ is set to be issued on Friday.

“However, in the event of the dissolution of the House of Representatives, the Speaker and Deputy Speaker of the House of Representatives who are in office shall remain in office until the day before filing nominations for the next election for the House of Representatives,” says Article 91 of Article 960 of the Nepalese Constitution.

Otherwise, the Speaker of the House of Representatives will preside. Or the position of Deputy Speaker will be vacant, as stated clearly in the writ.
