High Court rejects Shah’s reinstatement request

KATHMANDU: The Tulsipur High Court has refused to issue an interim order on a writ petition filed by former Ward Chair of Ghorahi Sub-Metropolitan City–8, Jitendra Shah, seeking reinstatement.
During today’s hearing, Chief Judge Rajeshwar Tiwari ruled that there was no ground to issue an immediate interim order.
The court, however, scheduled the next hearing for Bhadra 18 to hold discussions between both parties on whether an interim order should be granted.
The court has also directed Ghorahi Sub-Metropolitan City to submit, within 15 days through the Office of the Government Attorney, the reasons and evidence why such an order should not be issued.
Shah had submitted his resignation to Mayor Narulal Chaudhary on Asar 12, 2079 BS.
However, his resignation was formally accepted only on Bhadra 2, 2081 BS — more than two years later.
Challenging the delay and questioning the legality of the decision, Shah filed a writ petition demanding reinstatement to his position.
The court will decide on the issuance of an interim order only after hearing arguments from both sides.
