Sandeep taken to court for argument

KATHMANDU: Sandeep Lamichhane, the rape accused, has been taken to district court. The police arrested him and took him to court for a hearing.

His statement will be taken today, and a detention order will be issued. As the statement must be taken and the hearing must take place today, the order can only be issued tomorrow. Despite the fact that the police submitted the investigation report and opinion to the public prosecutor on Oct 23, the case was only filed a week later due to the Tihar holiday.

Associate Attorney Achyutamani Neupane, the head of the District Public Prosecutor’s Office in Kathmandu, stated that a case has been filed seeking a maximum sentence of 10 to 12 years in prison for Sandeep for extortion. ‘We have filed a case,’ Neupane said. Coercion has been charged with a maximum sentence of 12 years in prison. A demand for restitution has also been made. The court will now begin the process of statement and detention.’

Sandeep’s statement to the authorized officer, CCTV footage of hotels in Kathmandu and Nagarkot, the victim’s health examination report, and other evidence have been submitted in the case. In his statement to the authorized officer, Sandeep denied coercion. Other circumstantial evidence has been used as well.

The public prosecutor has sought punishment under clause (d) of section 219 (3) of the Criminal Code of 2074. In which there is a provision for a sentence of 10 to 12 years in prison for criminal offenses committed between the ages of 16 and 18. Sandeep, who is the same age as the victim, will face at least ten years in prison if convicted. According to the prosecution’s claim, the court can order the payment of fines and compensation. The charge sheet also requests that Sandeep’s property be frozen.

After the statement, the government lawyer and legal professionals from the defendant side will debate. Then the court will pronounce the order. The court will make a detention order to keep Sandeep in custody to proceed with the case process, to keep him on bail or to keep him on bail.

A young woman had filed a complaint against Lamichhane, the national team captain on the charge that she was raped the night before leaving for a friendly ODI and T20 tournament in Kenya, where he represented Nepal.

Following the incident on Aug 21, the girl filed a complaint at the Gaushala police station on Sept 6. Lamichhane allegedly molested the girl in hotels in Nagarkot and Kathmandu.

Lamichhane, who was in the Caribbean Premier League when the rape allegations surfaced, returned to Nepal on October 6. Lamichhane was apprehended at the airport on his way home. On September 8, the police took the arrest permit.
