NC seeks law change to allow land sales by developers

KATHMANDU: The Nepali Congress has decided to amend the existing legal provision that allows land development companies to purchase land beyond the legal ceiling but prohibits them from selling it.

Ghimire stated that the meeting also discussed resolving legal hurdles in the eighth amendment to the Land Act and incorporating additional provisions.
According to him, while the amendment permits companies to acquire land exceeding the ceiling for development purposes, the restriction on selling such land has posed a major obstacle to commercial implementation.
The Congress concluded that this issue must be addressed for effective land development.
The meeting also discussed the need to introduce a new law aimed at resolving the problems of unmanaged settlements, landless squatters, and Dalit squatters.
Ghimire mentioned that a draft bill has been prepared to distribute land ownership certificates (Lalpurja) to squatters residing on vacant land since before 2066 BS.
He said the bill will move forward with certain revisions.
The proposed legislation includes amendments to various sections of the Land Act, 2021 BS, notably Section 12, which seeks to allow the sale of land acquired under the ceiling exemption.
