SC to hear habeas corpus petition for Rabi Lamichhane’s release today

KATHMANDU: The Supreme Court is set to hear a habeas corpus petition filed for the release of Rastriya Swatantra Party (RSP) President Rabi Lamichhane today.
The petition was filed by Lamichhane’s wife, Nikita Poudel, claiming that his detention is unlawful and demanding his immediate release.
Lamichhane has been in custody since April 4 after the Butwal bench of the High Court Tulsipur overturned an earlier order by the Rupandehi District Court, which had released him on bail in connection with a fraud and organized crime case involving the Supreme Cooperative in Butwal.
Earlier, a single bench of Justice Tek Prasad Dhungana at the Supreme Court had sought a clarification report on the case. However, before the regular hearing could proceed, Nikita filed the habeas corpus petition.
The petition argues that Lamichhane has been detained in a non-judicial manner, violating legal procedures.
According to Nepal’s legal provisions, individuals who disagree with pretrial detention, bail, or surety orders can appeal to a higher court.
In cases involving life imprisonment or sentences of over 10 years, the law permits appeals to courts beyond the immediate appellate level.
Lamichhane’s legal team is now seeking judicial intervention to secure his release.
