KATHMANDU: The habeas corpus petition filed by Rastriya Swatantra Party (RSP) President Rabi Lamichhane has been marked as “not for hearing” by the Supreme Court.

The case, which was scheduled for hearing in a single bench of Justice Hari Prasad Phuyal, has been deferred with the court stating it falls under the “not for hearing” category.

Lamichhane, who is currently in judicial custody in connection with a cooperative fraud case, had filed the petition seeking his release.

The writ was submitted on Sunday by advocate Nikita Paudel on behalf of Lamichhane.

Earlier, the Butwal bench of the High Court Tulsipur had ordered Lamichhane’s remand on April 4 in the Supreme Savings and Credit Cooperative fraud case.

Prior to this, Lamichhane had also challenged the High Court’s order in the Supreme Court.

In response, the apex court had directed both the High Court and District Court to submit clarification reports regarding the ruling.
