KATHMANDU: The Pokhara High Court has ordered the submission of the kaifiyat (explanation) report regarding the Kaski District Court’s decision to release Rabi Lamichhane, former Home Minister and then Managing Director of Gorkha Media Pvt. Ltd., along with six others, on bail in the Surya Darshan Cooperative fraud case.

Hearing the appeal filed by the Pokhara High Government Attorney’s Office, a single bench of Judge Rajukumar Khatri issued the order on Tuesday.

Once the report is submitted, the case will proceed to a joint bench of two judges. “The single bench requested the kaifiyat report.

Once it arrives, the case will be registered and forwarded to a joint bench,” said Nilprasad Paneru, the information officer of the High Court.

He added that the case must be concluded within a month of receiving the report. “The kaifiyat report includes the reasoning and evidence cited by the district court when issuing its order. Generally, there is a 15-day timeframe for submitting such reports,” Paneru explained.

The Kaski District Attorney’s Office has demanded the detention of Lamichhane and the six others to proceed with the trial on charges of fraud, organized crime, and money laundering.

According to Paneru, the court may choose to notify Lamichhane and his legal team during the proceedings, although it is not mandatory. “The bench can proceed without notifying Lamichhane. However, he may also submit a petition to be involved in the defense, and the court may grant him that opportunity,” Paneru stated.
