Medical Professional Prasai’s petition against Bank rejected by court

KATHMANDU: Medical practitioner Durga Prasai’s writ petition filed against the bank has been dismissed.

Durga Prasai, a medical professional, had filed a petition in the High Court of Biratnagar, Ilam bench, seeking an injunction after the bank pressured him to repay his loan. The court has now dismissed his petition.

The High Court bench, consisting of Chief Justice Bipul Nyaupane and Judge Kaji Bahadur Rai, rejected the petition on Tuesday.

This decision clears the path for the bank to pursue loan recovery from Prasai.

He had taken loans from various banks for the operation of the Eastern Nepal Cancer Hospital, but has failed to repay them.

After a prolonged period of non-repayment, the banks had initiated the loan recovery process.

However, Prasai filed the petition in court, claiming he would not repay the loan, even threatening bank employees.

With the dismissal of the petition filed by lawyer Tika Ram Adhikari on behalf of Prasai, the banks now have the legal right to recover the loans.

If Prasai fails to pay the loan, the bank may auction the collateral to recover the debt.

Prasai had taken over 2 billion rupees in loans from four banks for the Eastern Nepal Cancer Hospital.
