KATHMANDU:  CPN (UML) has stated that the activities of the political parties, individuals and organizations of the Rastriya Swatantra Party (RSP) are against the rule of law.

UML General Secretary Shankar Pokhrel issuing a statement today mentioned that the party’s serious attention was drawn to such activities of RSP leaders and cadres while the implementation process of the parliamentary special committee’s report on misappropriation of funds of cooperatives is underway.

Based on the report prepared by the Parliamentary Special Committee, the investigation, prosecution and judicial process have been carried out and it is the common duty of all to assist in it, UML said. UML’s opinion is that it is very sad that when the investigation process is proceeding on the issues unanimously pointed out by the investigation committee, it is unfortunate to create confusion by evoking unhealthy expressions, insulting and making false accusations against the prime minister, responsible persons of the government and agencies.

It is the common responsibility of everyone to make the investigation, prosecution and defense of criminal cases independent, fearless and scientific, and make the effectiveness of the criminal justice system, press release reads.

Reminding that the law provides for separate bodies for investigation and prosecution, UML has considered that it is inappropriate from a judicial point of view to discuss RSP President Rabi Lamichhane’s arrest with the government and the leadership, and to unfairly influence the investigation and prosecution process.

The UML is of the opinion that it is a crime in itself to make a gathering of more than five people in order to prevent a civil servant from doing their jobs prescribed by law.

UML has stated that the presence of federal MPs in such agitation is illegal. “It is completely illegal for a member of the Federal Parliament to be present in such a crime and to incite others to commit such a crime. All parties should be aware that there is a legal provision that every person who disobeys the request of the police not to participate in such a gathering is considered a criminal,” the statement said.
