Case against Koshi govt to be decided by full bench

KATHMANDU: The hearing of the writ filed in the Supreme Court against Koshi Chief Minister Uddhav Thapa is going to be heard in full bench.
Even though Sapana Pradhan Malla and Sushmalata Mathema will be in the joint bench on Sunday for the full hearing of the petition filed with the claim that the vote of confidence was taken using the Speaker, it has been agreed to take it to the full bench. A full bench has more than 2 judges.
The hearing was postponed on Friday after the joint bench of Justices Ishwar Prasad Khatiwada and Mathema decided to hear the writ.
During the preliminary hearing of the writ, Judge Khatiwada issued a show cause order on Bhadra 7 (Aug 24).
The order states that the Supreme Court cannot regard the Speaker’s vote to be in compliance with the Constitution.
