KATHMANDU: The debate on writ opposing the Parliament Secretariat’s decision that Chief Justice Cholendra Shumsher JB Rana’s impeachment was ineffective concluded on Friday.

After the debate is over, preparations are being made to issue an order today. The Constitutional Bench consists of Chief Justice Hari Krishna Karki, Justices Bishwambhar Prasad Shrestha, Ishwar Prasad Khatiwada, Anand Mohan Bhattarai and Anil Kumar Sinha.

Senior advocate Tikaram Bhattarai stated in the opening debate that the impeachment will be presented in the new House of Representatives (HoR).

The Secretary General does not have the authority to write a letter of dismissal of the suspension, according to Section 9 of the Federal Parliament Secretariat Act. In other words, he reminded the audience of the General Secretary of the Parliament’s work, duties, and rights during the debate.

Similarly, Senior Advocate Badri Bahadur Karki stated that General Secretary Bharatraj Gautam should be prosecuted for contempt in the Parliament, which issued the letter dismissing Chief Justice Cholendra Shumsher JB Rana’s suspension.

He stated this while taking part in a debate on the writ against the ineffectiveness letter of suspension issued to Chief Justice JB Rana by Gautam, the General Secretary of the Federal Parliament.

‘Parliament officials mocked Parliament naked and shamelessly, those who ask for and write letters should be punished for contempt of Parliament,’ he said during the debate. The court should also take contempt action.’

Following Friday’s debate, legal professionals are holding internal discussions.
