KATHMANDU: The Supreme Court (SC) has ordered to maintain the candidature of Dr. Toshima Karki.

While hearing the petition filed by the Election Commission (EC) seeking the cancellation of Toshima’s candidacy, the SC upheld an earlier interim order allowing her to run.

The joint bench of Judges Ishwar Prasad Khatiwada and Til Prasad Shrestha concluded that assuming Toshima is in a profit position is not acceptable.

Karki, a Rastriya Swatantra Party candidate for the House of Representatives in Lalitpur 3, was rejected by the EC as she had not resigned as a member of the Medical Council. The writ claimed that the commission’s decision to disqualify him from the Nov 20 election was biased.

Karki’s candidacy was rejected by the EC as she was in a position of profit. The election law states that no one in a position of profit may run for office.

Despite the fact that she does not receive a regular salary, the EC rejected her candidacy as a position of benefit because she was given a time allowance during the meeting.

However, Karki filed an appeal with the SC against the EC’s decision, claiming that the position of Medical Council member is not a profit-making position.
