Balen’s displeasure with the SC order
The Supreme Court has scheduled a hearing with both parties for next Monday.
KATHMANDU: Balen Shah, Mayor of Kathmandu Metropolitan City, has expressed his displeasure after the Supreme Court (SC) issued a short-term interim order directing Norvic Hospital not to demolish the structure built on public land.
On Wednesday, a single bench of Supreme Court Judge Manoj Kumar Sharma issued an interim order refusing to remove the Norvic structure built on public land.
On Monday, Mayor Shah personally visited and posted a notice to demolish the Norvic Hospital structure in Thapathali. However, after the court halted it, Shah stated on social media, ‘We sincerely request that the Supreme Court amend the constitution and give the authority to take action against structures built without passing the map.’
The Supreme Court has scheduled a hearing with both parties for next Monday. According to Bimal Poudel, a Supreme Court spokesperson, the next order will be whether or not to continue this order after hearing both sides’ arguments.
According to him, when a writ is issued on any subject, it is a standard legal procedure for the bench to convene both parties for a debate and issue a short-term order not to implement the decision until then.
