Supreme Court rejects writ petition against decision to hold elections on May 13
KATHMANDU: FEB. 9 – Writ filed against the local elections scheduled for May 13 by the government the Supreme Court has rejected.
The Supreme Court has rejected the writ petition filed by Sanjeev Kumar Sah of Bhangha Municipality of Mahottari saying the elected date has not reached five years.
Shah is the mayor of Bhangha Municipality. On Tuesday, he filed the writ petition. On Wednesday, the Supreme Court administration granted his request. In the writ petition, he had demanded to be allowed to work till the end of his five-year term even though the election be held on May 13. However, Registrar Narayan Prasad Panthi has ordered the bench with the conclusion that he is not eligible to register the petition.
According to the Registrar’s Office order, while the provisions of the Act are still in effect, Mayor Sah attempted to register the petition on the basis of conjecture.
The order said, “As there is a strong possibility of reducing the five-year tenure of the mayor, the petition was brought without any basis and it was not allowed to register on the basis of Rule 18 of the Supreme Court Rules, 2074.”
