KATHMANDU: AUGUST 20 – On the basis of the ordinance on political parties, the Election Commission has issued ‘Political Parties (Second Amendment Rules, 2078 BS). The ordinance on political parties was issued last Wednesday.

The regulations have been published in the Nepal Gazette. After the publication of the rules in the Gazette, the way has been paved for the CPN-UML (Socialist) and the JSP (Democratic) to register their parties on Wednesday. Due to a lack of rules, the registration process of the new party could not proceed.

As soon as the rules are published in the Gazette, there is ample legal way to apply for the registration of a new party. As per the rules, in the case of a Central Committee elected by the General Convention and a party with a new party, at the time of registration of such party, 20 per cent or more members of the Central Committee or 20 per cent or more members of the Parliamentary Party of the Federal Parliament shall be present at the same time.

Similarly, if 20 per cent or more members of the Parliamentary Party of the Federal Parliament have applied to form a separate party, the Commission may inquire into the matter by writing to the Secretariat of the Federal Parliament.

As per the rules issued on the basis of the ordinance, if a new party is formed, a member of the State Assembly or a member of the local level elected on behalf of the party before the formation of such party shall be identified by the State Assembly member within 21 days of the formation of the party.

On the recommendation of the government, President Bidhya Devi Bhandari had issued an ordinance on political parties.
